Consent Agreement
I understand that I am voluntarily participating in a martial art/combat sport; by definition, the practice of which involving and regular exchanges of techniques and protocols that otherwise amount to harmful or offensive contact. By attaching my signature below, I am hereby consenting to receive such contact as a necessity of my training and participation, and thus, acknowledge that any contact cannot amount to legal battery or assault as defined by either criminal or civil statutes because it is consensual in nature.
I also understand that if I am within the training area, other participants are entitled to a presumption that I am consenting to the practice.
I also understand that though my consent is revocable at any time, it can only be so revoked by clear and unambiguous notice, verbal or written, which must be given in a timely manner such that other participants can reasonably respond to my revocation of consent. I understand that the practices in which I will participate are designed so that reflex is often insufficient to protect oneself should I suddenly feel as though I need to revoke consent. For this reason, I acknowledge that if practice or a technique is already underway, I cannot effectually revoke consent absent removing myself physically from the training area.
In the event that someone I am training with is attempting to revoke consent to the practice, then it is my duty to err on the side of abundant caution and immediately cease participation until I can ascertain my training partner’s degree of participation. This is my duty alone, and I will not defer to another’s judgment to determine whether my partner’s consent had been revoked or otherwise. I will not hold Next Generation Martial Arts, LLC or its agents and mandataries liable for any battery I may visit upon another who has revoked his consent.
These recognitions and agreements are necessary for the safety of all participants, including myself.
Waiver and Release of Liability: Next Generation Martial Arts, LLC
Express assumption of risk: I, the undersigned, am aware that there are significant risks involved in all aspects of physical training. These risks include, but are not limited to: falls which can result in serious injury or death, injury or death due to negligence on the part of myself, my training partner, or other people around me, and injury or death due to improper use or failure of equipment. I am aware that any of these above-mentioned risks may result in serious injury or death to myself and/or my partner(s). I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participation in any activity or class while at Next Generation Martial Arts, LLC. I, the undersigned acknowledge that I have no physical impairments or illnesses that will endanger others or myself.
Release: In consideration of the above mentioned risks and hazards and in consideration of the fact that I am willingly and voluntarily participating in the activities at Next Generation Martial Arts, LLC, I hereby release Next Generation Martial Arts, LLC, their principals, agents, employees, and volunteers from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my participation in these activities, including those allegedly attributed to the negligent acts or omissions of the above mentioned parties. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, and transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect. If I am signing on behalf of a minor child, I also give full permission for any person connected with Next Generation Martial Arts, LLC to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and or surgical care for the child and to transport the child to a medical facility deemed necessary for the well-being of the child.
Indemnification: The participant recognizes that there is risk involved in the types of activities offered by Next Generation Martial Arts, LLC. Therefore, the participant accepts financial responsibility for any injury that the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above mentioned parties, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless Next Generation Martial Arts, LLC, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by Next Generation Martial Arts, LLC.
Right to Terminate
I recognize the rights of Next Generation Martial Arts, LLC to choose, at its sole discretion, to involuntarily terminate the instant agreement and absolve itself of the obligation to continue instruction for any reason. I recognize Next Generation Martial Arts, LLC’s obligation to myself and other students/participants to ensure the safest, most effective culture of practice on their premises, and as such, relegate myself to their discretion as to how said culture is fostered. To this end, I understand that if my participation and behavior is not satisfactory in upholding to the creed and culture intended by Next Generation Martial Arts, LLC, they have the sole and exclusive authority to instantly and irrevocably, without objection or appeal, terminate the contractual relationship proscribed herein.
I also recognize that should such discretion be exercised, then I am entitled to neither refund nor recompense, and may in fact be held personally liable for any injury or offense my actions or failure to act may have caused.
Summarily, and in consideration for being allowed to participate in Next Generation Martial Arts, LLC exercise programs, I agree to assume the risk of such exercises, and further agree to hold harmless Next Generation Martial Arts, LLC and its staff members from any and all claims, suits, losses, or related causes of action for damages, including, but not limited to, such claims that may result from my injury or death, accidental or otherwise, during or arising in any way from, the exercise programs. I understand that by signing this form I am waiving valuable legal rights.
